Why its illegal to sell gold in Tasmania today? or is it?

The Tasmanian mineral resource development Act was changed in 1995. Prior to this we could sell gold and we did get miners right in Tasmania. Plenty of small scale prospectors and small scale miners benefited from this arrangement. As did the mines department. Again, any Act, by any State that is totally different to the rest of this Nations, under our constitution, is invalid.

Why did miners rights stop in Tasmanian and nowhere else in Australia? in the entire Commonwealth. When Commonwealth nations in whoop whoop get a better deal than us and MRT can afford more for ranger duties and the like. You have to feel sorry for the poor downtrodden sods in Hobart struggling to get a modern vehicle fleet that can cope with the harsh urban environment and modern websites and communications system upgrades, to keep the state moving forward.

Or was it Because it was simply not worth Mineral resources Tasmania's time and effort to do it. CBF... Have a tier of licence, just like everybody else. That would not turn Tasmanian prospectors into criminals hell bent on conspiring to defraud the Crown of its precious. thankfully under the Constitution, We are not.

109. Inconsistency of laws
When a law of a State is inconsistent with a law of the Commonwealth, the latter shall prevail, and the former shall, to the extent of the inconsistency, be invalid.

117. Rights of residents in States
A subject of the Queen, resident in any State, shall not be subject in any other State to any disability or discrimination which would not be equally applicable to him if he were a subject of the Queen resident in such other State.

Really, its a shame that prospecting licences, as well as driving licences aren't issued by the Commonwealth, with the same laws and regulations applying in all states equally. Would be like magic.
However, with the massive egos of most pollies and their reluctance to lose any of their power, it would never ever happen.
